Today I had the worst ever experience with Modern Automobiles, Chandigarh. They are totally fraud. Their Sales Executive Tilak (Mob. 97800-64310) is No.1 Liar, corrupt. And their Sales Manager Deepak is more than him. We are to buy one Alto Standard and Tilak called us saying that the car is available. We came from Manali only to hear that they dont have car available. When asked why he called us and also shown them the DD issued by the financing bank, he has no reply. We approached his Sales Manager, but he showed no regrets no appologies. We asked to provide their owner&#039;s contact number or any other senior person&#039;s name or phone number. Nothing has been provided. I never such irresonsible people, who never care for their customers. If you are planning to buy any maruti car from Modern Automobiles, Chandigarh, think 100 times before you buy from them.?

Sir,
It is submitted that I Sandeep Gahlawat S/o Sh. Inder Singh is resident of House No. 1788 sector 23-B, Chandigarh.

1.	That persuaded by the advertisement n the News paper for discount on car in the end of year, on 23.12.2009 I made a telephonic call to Modern Automobiles, which is situated at 4MW, Industrial Area, Phase-1, Chandigarh and enquired about the cost of Maruti Alto Lxi and discount available on the said car. The person who picked my call, replied me that a sale executive on behalf of dealer will make a call to me within few minutes and will give me all details. Then I received a call on my mobile bearing No. 92169999880 from a sale executive, who told me that he is from Modern Automobile and his name is Hemant. Then he gave me details about the Car Maruti Alto Lxi. I also asked him about any special discount available to Advocates upon which he replied that if I visit to the Show Room then he would do something in this regard also.

2.	That on his assurance, I went to Modern Automobiles, where one executive, namely, Anju, met me. I told her that I want to meet Mr. Hemant upon which she replied that he is not available and if she could help me. I told her that I want to purchase Alto Lxi. Then she told me about the car and also asked me not to disclose to anyone that I also enquired on telephone and I had a talk with Hemant otherwise the commission will go to Hemant. I told her that I am here to purchase a car, it hardly any matters to me who sells it. I also asked her about any special/corporate discount upon which she discussed my case with Mr. Deepak Girdhar, who is Sales Manager at Modern automobiles. After discussion they told me that Rs.2000/- will be deducted from the actual cost of car.

3.	That after getting all details regarding the price and discount, I expressed my wish to purchase the ALTO LXi car in ECRO BIDGE colour.

4.	That sales executive, namely, Ms. Anju also asked me about the mode of payment upon which I replied her that I can pay only Rs. 78,000/- to 80,000/- in cash and for rest of the amount I will apply for loan. Then she told me that the agents on behalf of all the banks are available with their dealer also and whether I would like to get my loan processed from their agents. Upon which I replied her if it is easy from here then I would like to get it done from here. Then she discussed my case regarding loan with Sh. Amit, who deals in loan, he after going through my documents replied that car loan for amount of Rs. 2 lacs is not possible. Then Ms. Anju discussed my case with Sh. Deepak Girdhar (Sales Manager), who after making 2-3 calls from his mobiles to bank agents replied me that he will get it done. He also asked me to book the car by depositing some amount and told me that I had to bring some other documents which are necessary for loan as I was not having my Bank statement with me at that time. 

5.	That on the assurance of Mr. Deepak Girdhar and Ms. Anju I agreed to purchase a Maruti Alto car Lxi as they were ready to finance me Rs. 2 Lacs loan from the bank also. I deposited Rs. 1000/- as booking amount with Modern Automobiles against which they issued me a receipt No. 39326 dated 23.12.2009.

6.	That I went again to the Modern automobiles on 24.12.2009 and deposited Rs. 5000/- more as Booking amount because Ms. Anju told me that my booking is less and for that reason I had to deposit Rs 5,000/- more against which they issued me a receipt 73840 dated 24.12.2009. I also deposited my document (copy of Pan Card, Voter Card, Driving License, 2 photocopies of ITR of the last two years, bank statement of last six months, photocopy of Landline phone bill, electricity bill along with 2 photogarphs) with Ms. Anju. They gave me assurance that the car will be delivered to you as soon as possible, I made a request to them that it is my birthday on 29th of December and if they can do it before 29th of December. They assured me that they will do it.

7.	That on 28th of December 2009, one person came to my house and told me that he is from the verification department and he is to verify some details. He asked certain questions to me to satisfy himself for the verification purpose. After 10 minutes he told me that my verification has done and it is positive now I can have my car from the dealer and my loan will be sanctioned soon.

8.	That on the same day, i.e., on 28.12.2009 at about 3:30 P.M. I went to the Modern Automobiles and asked about the status of my loan upon which Ms. Anju discussed it with Mr. Deepak Girdhar. They both replied me that Loan of Rs. 2 lacs cannot be given to me as I was not having any guarantor. They also told me that if I had to take loan I had to arrange one guarantor. I showed my inability to do so upon which they made me to sit there and asked to wait for sometime as they were trying to get it done by some other banks. That after one and a half hour I asked them to refund my money (Rs. 6000/-) which was deposited with them as booking amount upon which they replied that they are trying and they assured me that they will get it done. That at about 5:30 P.M. they told me that Rs. 2 lacs is not possible but they can get the loan sanctioned for an amount of Rs. 1.5 lacs/-. I told them that I am not interested and I do not want to purchase the car from them because if the loan of Rs. 2 lacs could not be sanctioned to me why they sent the person from verification department. Then they assured me that only a marginal difference will be there in installments upon which I enquired from them about the installments and rate of interest. They told me that for an amount of Rs. 1.5 lacs for a period of 3 years, I had to pay 36 installments of Rs. 4875/- each along with Rs.2275/- as process fee. On their assurance of getting my loan sanctioned for a sum of Rs. 1.5 lacs, I agreed to purchase the said car. They asked me about the remaining amount, I told them that I have to arrange Rs. 40,000/- more as I was having Rs. 80,000/- with me at that time. I went to my home for taking the remaining amount and I reached at Modern Automobiles at about 6:40 P.M. along with the remaining amount. I deposited Rs.1,15,219/- to them against which they issued me a receipt No. 73916 dated 28.12.2009. I also gave them a cheque for on amount of Rs. 7140/- (already encashed) as they asked me that you have to deposit the 1st installment in advance along with process fee.
9.	That after all this process they told me that the colour of my choice was, not available with them and if had to purchase the car only Red and Silky silver colour are available. As I had deposited the money with them they told me that now I have to purchase the car otherwise money cannot be refunded back. The colour ECRO BIDGE was mentioned on receipt of Rs. 1000/- for booking amount by Mrs. Anju.

10.	That as I wanted to have the car on my birthday on 29.12.2009, and due to this reason I agreed to have Silky Silver Colour. I agreed to have it on 28.12.2009 at about 7:30 P.M. They delivered me the said car at about 7:40 P.M. It was dark and fog at that time it was not easy to see the scratches and defects in the car. As it never came to my mind that the car might be accidental and defective one as I was purchasing a new car and from a reputed dealer.

11.	That in the next morning i.e. that is on 29th of December 2009, when I looked at my car  on it rear side I had some doubt as there were some scratches on the rear pillar and rear door.

12.	That at about 10:30 A.M. I rushed to the dealer to complain that my car is defective one upon which Ms. Anju and Deepak Girdhar said after a washing they will be removed they got my car washed but still they were there. Then they said I need not to worry as the scratches are nothing but dust only and will be removed during first service. 

13.	That I got my first service done on 14.01.2010 but even after the service the scratches remained as they were. Then I had a suspicion that this car is painted one and they had cheated me by fraudulently selling this accidental, defective and old painted car to me. That after the service I contacted Mr. Deepak Girdhar about this problem he told me that I have to leave the car with him for 24 hours and he will get it repaired. He also introduced one Kamaljeet, who deals in loan to me. Said Kamaljeet and Deepak Girdhar sat with me on a table and asked me that my loan for an amount of Rs. 1.5 lacs cannot be sanctioned without guarantor. Then I replied that that when they agreed to do so earlier it is upto them how they get it but I do not have any guarantor. Then they said that I have to pay entire amount in cash only upon which I replied them I will try for a guarantor. Then after this they told me that either I should arrange for a guarantor otherwise they will not hand over me the papers of car (Sale certificate and other documents which are necessary for registration).  

14.	That I discussed it with my friends who had also purchased the car in the month of December and they were also of the opinion that the car is painted and defective one. To verify this, on 16.01.2010, I went to Berkley Automobile which is also an agency/dealer of Maruti Suzuki, situate at Industrial Area Phase-1, Chandigarh. I told the executives present there that I want to sell my Maruti Alto car Lxi which I purchased on 28th of December 2009. Then they introduced me with one Anil Chaudhary who on behalf of TRUE VALUE inspected my vehicle and also asked me the reason for selling the car so early upon which I replied him that after selling this car I will purchase Swift car. He made an estimate of my car to the tune of Rs. 2.15 lacs. When I asked him the reason he told me that the Bonnet of my car is changed one as there is gap on both the sides of bonnet and scratches on all the screws of bonnet. Rear pillar of left side is painted one as there are marks of clear spray also which is done after paint. I asked them to give me a copy of their estimate upon which they denied to give it to me.

15.	That officials, owner of Modern Automobiles, Industrial Area, Chandigarh have cheated me dishonestly induced me to pay the amount of Rs. 1,21,219/- (cash) and Rs. 7140 (cheque already encashed) and rest of the amount being the loan from the bank in their favour and have delivered  me an accidental and painted car stated it to be a brand new car. It has caused wrongful gain to them and wrongful loss to me.

16.	That the officials/ owner of Modern Automobiles, Industrial area, Chandigarh, have delivered the car to me even without sanction of loan from the H.D.F.C. Bank. They have given assurance that they would get the loan sanctioned. It is pertinent to mention here that said loan has not even been sanctioned till date. It clearly shows their malafide intention to foist their old, defective and panted on e vehicle in the shape of new vehicle to me. 

17.	That I tried a lot to get this matter resolved and I also contacted the regional office of Maruti situated in Sector 8, Madhya Marg, Chandigarh, where it was settled that Deepak Girdhar ( sales manager) will give an additional discount of Rs. 15,000/- for the damage in car and will also get repaired the all defects of the car. The official, who met me at regional office, was Mr. Prince. Upon which I was not satisfied but agreed to do so when Deepak Girdhar promised me that he will sell this car to another person and will hand over my entire money which I have already paid to them. But he asked me to deposit rest of the amount also because he told me that only by paying the whole payment, I can become the owner and then it will be sold to subsequent purchaser. In this way the subsequent purchaser will become the 2nd owner of the car in question. I became ready to do so and only on his assurance, I paid another sum of Rs. 1, 27,860/- on 23.01.2010 vide receipt No. 74591. After this he replied me that as now I have made the whole payment and the car was purchased in cash, so hypothecation is to be removed from all the documents and the process will take time of three days. 

18.	That after three days when I contacted him he made an excuse that process will take more time. But when I contacted on 4th February 2009 with Mr. Deepak Girdhar, he told me that only after paying an amount of Rs. 15,000/- more, all the documents will be given to you and then you can register the said vehicle in your name and if you want to sell it you can do anything at your own level. He further replied me that neither he nor his agency can help me in any way.   

It is, therefore, respectfully prayed that F.I.R. under Section 420 of the IPC against aforesaid officials and owner of Modern Automobiles be registered and strict legal action be taken against them for cheating me and by selling an old, accidental and defective car to me by stating it to be ne one.

Deepak Girdhar (Sales Manager), who after making 2-3 calls from his mobiles to bank agents replied me that he will get it done. He also asked me to book the car by depositing some amount and told me that I had to bring some other documents which are necessary for loan as I was not having my Bank statement with me at that time. </p>
<p>5.	That on the assurance of Mr. Deepak Girdhar and Ms. Anju I agreed to purchase a Maruti Alto car Lxi as they were ready to finance me Rs. 2 Lacs loan from the bank also. I deposited Rs. 1000/- as booking amount with Modern Automobiles against which they issued me a receipt No. 39326 dated 23.12.2009.</p>
<p>6.	That I went again to the Modern automobiles on 24.12.2009 and deposited Rs. 5000/- more as Booking amount because Ms. Anju told me that my booking is less and for that reason I had to deposit Rs 5,000/- more against which they issued me a receipt 73840 dated 24.12.2009. I also deposited my document (copy of Pan Card, Voter Card, Driving License, 2 photocopies of ITR of the last two years, bank statement of last six months, photocopy of Landline phone bill, electricity bill along with 2 photogarphs) with Ms. Anju. They gave me assurance that the car will be delivered to you as soon as possible, I made a request to them that it is my birthday on 29th of December and if they can do it before 29th of December. They assured me that they will do it.</p>
<p>7.	That on 28th of December 2009, one person came to my house and told me that he is from the verification department and he is to verify some details. He asked certain questions to me to satisfy himself for the verification purpose. After 10 minutes he told me that my verification has done and it is positive now I can have my car from the dealer and my loan will be sanctioned soon.</p>
<p>8.	That on the same day, i.e., on 28.12.2009 at about 3:30 P.M. I went to the Modern Automobiles and asked about the status of my loan upon which Ms. Anju discussed it with Mr. Deepak Girdhar. They both replied me that Loan of Rs. 2 lacs cannot be given to me as I was not having any guarantor. They also told me that if I had to take loan I had to arrange one guarantor. I showed my inability to do so upon which they made me to sit there and asked to wait for sometime as they were trying to get it done by some other banks. That after one and a half hour I asked them to refund my money (Rs. 6000/-) which was deposited with them as booking amount upon which they replied that they are trying and they assured me that they will get it done. That at about 5:30 P.M. they told me that Rs. 2 lacs is not possible but they can get the loan sanctioned for an amount of Rs. 1.5 lacs/-. I told them that I am not interested and I do not want to purchase the car from them because if the loan of Rs. 2 lacs could not be sanctioned to me why they sent the person from verification department. Then they assured me that only a marginal difference will be there in installments upon which I enquired from them about the installments and rate of interest. They told me that for an amount of Rs. 1.5 lacs for a period of 3 years, I had to pay 36 installments of Rs. 4875/- each along with Rs.2275/- as process fee. On their assurance of getting my loan sanctioned for a sum of Rs. 1.5 lacs, I agreed to purchase the said car. They asked me about the remaining amount, I told them that I have to arrange Rs. 40,000/- more as I was having Rs. 80,000/- with me at that time. I went to my home for taking the remaining amount and I reached at Modern Automobiles at about 6:40 P.M. along with the remaining amount. I deposited Rs.1,15,219/- to them against which they issued me a receipt No. 73916 dated 28.12.2009. I also gave them a cheque for on amount of Rs. 7140/- (already encashed) as they asked me that you have to deposit the 1st installment in advance along with process fee.<br />
9.	That after all this process they told me that the colour of my choice was, not available with them and if had to purchase the car only Red and Silky silver colour are available. As I had deposited the money with them they told me that now I have to purchase the car otherwise money cannot be refunded back. The colour ECRO BIDGE was mentioned on receipt of Rs. 1000/- for booking amount by Mrs. Anju.</p>
<p>10.	That as I wanted to have the car on my birthday on 29.12.2009, and due to this reason I agreed to have Silky Silver Colour. I agreed to have it on 28.12.2009 at about 7:30 P.M. They delivered me the said car at about 7:40 P.M. It was dark and fog at that time it was not easy to see the scratches and defects in the car. As it never came to my mind that the car might be accidental and defective one as I was purchasing a new car and from a reputed dealer.</p>
<p>11.	That in the next morning i.e. that is on 29th of December 2009, when I looked at my car  on it rear side I had some doubt as there were some scratches on the rear pillar and rear door.</p>
<p>12.	That at about 10:30 A.M. I rushed to the dealer to complain that my car is defective one upon which Ms. Anju and Deepak Girdhar said after a washing they will be removed they got my car washed but still they were there. Then they said I need not to worry as the scratches are nothing but dust only and will be removed during first service. </p>
<p>13.	That I got my first service done on 14.01.2010 but even after the service the scratches remained as they were. Then I had a suspicion that this car is painted one and they had cheated me by fraudulently selling this accidental, defective and old painted car to me. That after the service I contacted Mr. Deepak Girdhar about this problem he told me that I have to leave the car with him for 24 hours and he will get it repaired. He also introduced one Kamaljeet, who deals in loan to me. Said Kamaljeet and Deepak Girdhar sat with me on a table and asked me that my loan for an amount of Rs. 1.5 lacs cannot be sanctioned without guarantor. Then I replied that that when they agreed to do so earlier it is upto them how they get it but I do not have any guarantor. Then they said that I have to pay entire amount in cash only upon which I replied them I will try for a guarantor. Then after this they told me that either I should arrange for a guarantor otherwise they will not hand over me the papers of car (Sale certificate and other documents which are necessary for registration).  </p>
<p>14.	That I discussed it with my friends who had also purchased the car in the month of December and they were also of the opinion that the car is painted and defective one. To verify this, on 16.01.2010, I went to Berkley Automobile which is also an agency/dealer of Maruti Suzuki, situate at Industrial Area Phase-1, Chandigarh. I told the executives present there that I want to sell my Maruti Alto car Lxi which I purchased on 28th of December 2009. Then they introduced me with one Anil Chaudhary who on behalf of TRUE VALUE inspected my vehicle and also asked me the reason for selling the car so early upon which I replied him that after selling this car I will purchase Swift car. He made an estimate of my car to the tune of Rs. 2.15 lacs. When I asked him the reason he told me that the Bonnet of my car is changed one as there is gap on both the sides of bonnet and scratches on all the screws of bonnet. Rear pillar of left side is painted one as there are marks of clear spray also which is done after paint. I asked them to give me a copy of their estimate upon which they denied to give it to me.</p>
<p>15.	That officials, owner of Modern Automobiles, Industrial Area, Chandigarh have cheated me dishonestly induced me to pay the amount of Rs. 1,21,219/- (cash) and Rs. 7140 (cheque already encashed) and rest of the amount being the loan from the bank in their favour and have delivered  me an accidental and painted car stated it to be a brand new car. It has caused wrongful gain to them and wrongful loss to me.</p>
<p>16.	That the officials/ owner of Modern Automobiles, Industrial area, Chandigarh, have delivered the car to me even without sanction of loan from the H.D.F.C. Bank. They have given assurance that they would get the loan sanctioned. It is pertinent to mention here that said loan has not even been sanctioned till date. It clearly shows their malafide intention to foist their old, defective and panted on e vehicle in the shape of new vehicle to me. </p>
<p>17.	That I tried a lot to get this matter resolved and I also contacted the regional office of Maruti situated in Sector 8, Madhya Marg, Chandigarh, where it was settled that Deepak Girdhar ( sales manager) will give an additional discount of Rs. 15,000/- for the damage in car and will also get repaired the all defects of the car. The official, who met me at regional office, was Mr. Prince. Upon which I was not satisfied but agreed to do so when Deepak Girdhar promised me that he will sell this car to another person and will hand over my entire money which I have already paid to them. But he asked me to deposit rest of the amount also because he told me that only by paying the whole payment, I can become the owner and then it will be sold to subsequent purchaser. In this way the subsequent purchaser will become the 2nd owner of the car in question. I became ready to do so and only on his assurance, I paid another sum of Rs. 1, 27,860/- on 23.01.2010 vide receipt No. 74591. After this he replied me that as now I have made the whole payment and the car was purchased in cash, so hypothecation is to be removed from all the documents and the process will take time of three days. </p>
<p>18.	That after three days when I contacted him he made an excuse that process will take more time. But when I contacted on 4th February 2009 with Mr. Deepak Girdhar, he told me that only after paying an amount of Rs. 15,000/- more, all the documents will be given to you and then you can register the said vehicle in your name and if you want to sell it you can do anything at your own level. He further replied me that neither he nor his agency can help me in any way.   </p>
<p>It is, therefore, respectfully prayed that F.I.R. under Section 420 of the IPC against aforesaid officials and owner of Modern Automobiles be registered and strict legal action be taken against them for cheating me and by selling an old, accidental and defective car to me by stating it to be ne one.</p>
